There has been a steady decline in the number of planning enforcement notices issued by local authorities over the last few years.
Breaches of planning law do still occur, but why the drop in planning enforcement notices?
There seem to be 3 main reasons:
- Cuts to council budgets
It is just not cost effective for councils to pursue developers in some instances where planning rules have been disregarded. Therefore no action is taken.
2. Permitted development rights have been expanded. This affects:
- Development rights for house extensions
- Alterations to commercial premises
- Change of use for buildings
- Conversion of buildings for residential use
- This makes it easier to build a development without infringing planning rules.
3. People are more aware of policy requirements and planning laws.
Homeowners and businesses are not taking risks with development. But they are ensuring that they adhere to the laws by seeking specialist advice before proceeding.
Planning policy and law is complex and can be a minefield for the novice. It is therefore highly advisable to obtain the correct advice for your development so that you abide by all relevant laws and policies and avoid any conflict with the planning authorities.
